These GTC shall apply in addition.<\/span><\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cd36546 elementor-widget elementor-widget-spacer\" data-id=\"cd36546\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-044ac7c elementor-widget elementor-widget-heading\" data-id=\"044ac7c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-large\">\u00a7 2 Performance model\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-de71e45 elementor-widget elementor-widget-text-editor\" data-id=\"de71e45\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ol><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Standard services<\/b><span style=\"font-weight: 400;\"> result from the offer, service description or individual contract.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Agile approach (Scrum).<\/b><ol><li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">If the parties agree on Scrum or another agile model, roles, artifacts (product\/sprint backlog, product increment) and processes are based on the respective contract or the Scrum Guide (Schwaber\/Sutherland).<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Released sprint or product backlogs are considered binding service descriptions in accordance with \u00a7 631 BGB.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Expenditure and deadlines are forecasts; changes are prioritized jointly.<\/span><\/li><\/ol><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Verbal collateral agreements do not exist. Changes must be made in writing. Additional services shall be remunerated at 150 \u20ac\/hour.<\/span><\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7c6b54e elementor-widget elementor-widget-spacer\" data-id=\"7c6b54e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9a24068 elementor-widget elementor-widget-heading\" data-id=\"9a24068\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-large\">\u00a7 3 Obligations of the customer to cooperate\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b29f72c elementor-widget elementor-widget-text-editor\" data-id=\"b29f72c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ol><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The customer shall provide all information, content, access and contacts required for the project in good time and check interim results without delay.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If the client is in default of acceptance or cooperation, the agency may demand compensation for additional expenses and resulting damages (\u00a7 642 BGB).<\/span><\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ac14eb3 elementor-widget elementor-widget-spacer\" data-id=\"ac14eb3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7154a51 elementor-widget elementor-widget-heading\" data-id=\"7154a51\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-large\">\u00a7 4 Remuneration, due date, prices\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f36a705 elementor-widget elementor-widget-text-editor\" data-id=\"f36a705\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ol><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Payment modalities according to order value:<\/span><ol><li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Projects up to \u20ac 20,000 net:<\/span><ol><li style=\"font-weight: 400;\" aria-level=\"3\"><span style=\"font-weight: 400;\">100 % of the order amount upon conclusion of the contract<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"3\"><span style=\"font-weight: 400;\">Payment before the start of the project<\/span><\/li><\/ol><\/li><li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Projects over \u20ac 20,000 net:<\/span><ol><li style=\"font-weight: 400;\" aria-level=\"3\"><span style=\"font-weight: 400;\">50 % of the order amount upon conclusion of the contract as a down payment<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"3\"><span style=\"font-weight: 400;\">Remaining amount in monthly installments of at least \u20ac 10,000<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"3\"><span style=\"font-weight: 400;\">Monthly invoicing based on services actually provided (Time &amp; Materials)<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"3\"><span style=\"font-weight: 400;\">Invoices are issued without detailed time sheets<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"3\"><span style=\"font-weight: 400;\">Last installment can be less than \u20ac10,000 if the remaining amount is lower<\/span><\/li><\/ol><\/li><\/ol><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In the event of late payment, all obligations of the agency shall be suspended. Rights of use shall not be transferred until payment has been made in full.<\/span><\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ff16eef elementor-widget elementor-widget-spacer\" data-id=\"ff16eef\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-69f2c6c elementor-widget elementor-widget-heading\" data-id=\"69f2c6c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-large\">\u00a7 5 Subcontractors \/ processors\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0943093 elementor-widget elementor-widget-text-editor\" data-id=\"0943093\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ol><li><span style=\"font-weight: 400;\">The agency may use qualified subcontractors.<\/span><\/li><li><span style=\"font-weight: 400;\">Insofar as subcontractors process personal data, the agency concludes an order processing contract with them in accordance with Art. 28 GDPR and informs the client in advance. The current list of subcontractors used is available at <a href=\"https:\/\/www.appleute.de\/en\/subprocessors\/\" target=\"_blank\" rel=\"noopener nofollow noreferrer\">https:\/\/www.appleute.de\/subprocessors\/<\/a><\/span><\/li><li><span style=\"font-weight: 400;\">The agency shall be liable for the actions of its subcontractors as for its own conduct.<\/span><\/li><li>The customer shall be informed of changes to the subcontractor list by e-mail at least 14 days in advance. The customer may object to the change for good cause under data protection law; in this case, both parties shall have an extraordinary right of termination.<\/li><li>If subcontractors are based outside the EEA or transfer data there, the agency ensures that an adequate level of data protection is guaranteed (Art. 44 ff. GDPR), in particular by concluding standard contractual clauses (Art. 46 para. 2 lit. c GDPR).<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0f78881 elementor-widget elementor-widget-spacer\" data-id=\"0f78881\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0b8084c elementor-widget elementor-widget-heading\" data-id=\"0b8084c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-large\">\u00a7 6 Acceptance \/ Release\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-05c1f00 elementor-widget elementor-widget-text-editor\" data-id=\"05c1f00\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ol><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Agile projects:<\/b><span style=\"font-weight: 400;\"> Each Sprint Increment is deemed ready for acceptance.
